The case of John Doe v. Biff Tannen and George McFly
Back to the future has always been my favorite movie. As I watched recently, a Car insurance problem interesting approach.
Today (ie 1985) Biff Tannen, ably played by Thomas F. Wilson, Director George McFly in the workplace. George, as everyone knows, is the father of our hero, Marty McFly (Michael J. Fox). Unfortunately for Marty, at the beginning of the film and just before his big weekend on the lake with wrecks Jennifer Biff George car.
As Marty in his house, Biff and George had a heated exchange about the accident. Biff insists the fact that the car had a blind spot. George does not remember any blind spot, but Biff is supposed to pay for damage insurance. Biff said: "It the car! Your insurance should pay for it. "Then Biff said that George must also pay his dry cleaning bill because they spilled beer on himself another car when he ran into him.
So I said, "This is Biff is obviously drinking and driving .. I could really hurt someone What if he had? "
In such cases in Minnesota, George would probably be shocked to discover that Biff is right. George is legally liable for the negligence Biff. If Biff is to have hurt someone that fateful night, George insurance not only pay compensation insurance of the injured person before Biff pay, but George is also likely if the defendant never claimed Biff.
Under Minnesota law, auto insurance covers cars and people. Buy insurance available to protect you when you drive your own car, while driving other cars with permission. This way, you do not tell your insurance agent about it each When you use someone else's car or let someone use your car. So when someone borrows a car, George and Biff situation arise, since there are at least two policies covering the event.
So, you pay an injured person first? Minnesota law says that auto insurance is considered "closer to the risk" for what will be the primary insurance, while any insurance underwritten by the driver will be available as an additional guarantee. Biff would be a permissive user "insured under the policy of George. If the injured person have a higher demand that the policy George Biff policy would place the franchise. If the injured person underinsured motorist good insurance (UIM) up in your car, that the policy came last, after the policy Biff, to provide another layer of insurance.
Levels insurance cover, which not only compensate those injured and to protect Biff, but also to protect George, the owner of the car, the responsibility of others. Vicarious liability alleged negligence by a borrower to the owner by law. Under Minn. Stat. 170.54, when the right to drive Biff Biff George, George has become an agent is legally responsible for Biff George shares. So if uninsured Biff, George could be responsible for all damages. If Biff does great damage, George may be personally liable for injury an innocent person, even if it was miles from the accident.
The moral of the story about George is that he should know better than to leave the drive in your car Biff, but Biff became his supervisor and George is not very good in combat. Given the propensity Biff drinking and driving, hunting skaters in the middle of the street and trucks run on manure, Biff is likely to get George got into a big mess.
When you or someone you know is injured in a car accident, it is important to resolve issues of ownership and insurance before settling a claim. Be sure to talk with an experienced lawyer regarding insurance coverage for you.
